NEET Protest FIR Case: Supreme Court Hearing Today

The Supreme Court will hear Delhi Police's plea seeking cancellation of 13 FIRs and permission to investigate 2,873 protesters

permission for cancellation of FIRs made against 13 persons in relation to the protests that took place in connection with the allegations of irregularities in the NEET examination. The police have also asked for permission to file fresh FIRs against 2,873 persons who were found to be present at the site of the protests. This case has come up before a bench headed by Chief Justice Surya Kant, along with Justices Joymalya Bagchi and V. Mohana.

Application for Striking Out of 13 FIRs Filed by Delhi Police

As per the application, Delhi Police does not wish to move forward in 13 FIRs that were filed in connection with the protests carried out by the Cockroach Janata Party (CJP). This application comes due to a decision made by the Center on July 25. The police has moved the Supreme Court requesting intervention from the Supreme Court under Article 142 of the Constitution. As per Solicitor General Tushar Mehta, an interim application was being filed in connection with the application to strike out the FIRs. The matter has been listed for hearing by the Supreme Court after being appraised about the interim application.

Why 2,873 Individuals Come Under Scrutiny

While approaching for cancellation of the FIRs that are already filed, the Delhi Police has also pointed out the importance of investigating the role of those individuals who had criminal background and were present during the demonstrations. It is being stated in the application that, based on information obtained from the NCRB database, there were 2,873 individuals who had a serious criminal history and were present during the demonstrations. Police says that it is important to investigate their participation in the acts of violence. Hence, it has asked for permission to file new cases and inquire into the role of these individuals.

Remarks made by Supreme Court Regarding the Settlement

In the process, the Supreme Court has expressed that it would not mind if a settlement was being reached between the parties.

It is important to note that the petition deals with not only the withdrawal of criminal proceedings but also a new case against those connected with violence witnessed during the protest. The Supreme Court’s decision on the police application will decide the fate of these cases.

The issue surrounding NEET test has remained a sensitive one, with students and their families constantly raising concerns about irregularities in the examination process. Moreover, the protests have invited some legal and political considerations especially with regard to the manner in which the demonstrations and criminal cases were filed during the agitation. The Delhi Police's recent petition raises two different considerations before the Supreme Court; whether the 13 FIRs filed with respect to the protest should be closed and whether further investigation proceedings should be launched regarding the alleged involvement of 2,873 people.
