Jantar Mantar Supreme Court appoints a high-powered committee to probe allegations of pellet gun use and misbehavior with women
Jantar Mantar Police Action Case: The Supreme Court has appointed a five-member powerful committee to look into the case relating to police actions taken in connection with a parliament march from Jantar Mantar. It includes allegations of using pellet guns against protesters and allegations of improper conduct with women in the process of police action.The committee is headed by the former Supreme Court judge R. Subhash Reddy. Other members of the committee are former Punjab & Haryana High Court Chief Justice Ravi Shankar Jha, former Delhi High Court Judge Shalinder Kaur, former CBI Director Rishi Kumar Shukla and retired DGP Meghalaya Dr. L.R. Bishnoi.The Supreme Court had taken the decision to form such a committee while hearing the case on August 18.
Supreme Court Panel To Review Police Performance
Supreme Court: This panel has been set up following the complaints that have emerged about how the police conducted themselves while dealing with the protesters who went on a march to Parliament.The five-member panel would look into the issues related to the said incident and the complaints leveled against the police force. The members include representatives from the judiciary, investigation and policing backgrounds.The addition of the former Supreme Court judge as chairman would provide the panel with a chairperson with judicial experience, while the former senior police and CBI officials would add investigative experience to the panel.
March to Parliament Was Held After Protests Had Lasted Long Enough
March to Parliament: Protest against irregularities in NEET paper leak and examination process took place for 36 days at Jantar Mantar and stopped only after a call was made for the resignation of Education Minister Dharmendra Pradhan on July 25.As per the facts of the case, protesters tried to march to Parliament on July 20. It is during this march that some allegations were made against the police of Delhi.Excessive use of force during this march was one allegation made by the protesters against the Delhi police. Use of pellet guns was another accusation against the Delhi police. Misconduct with women protesters was yet another allegation brought before the Supreme Court.
Illegal Parade by Delhi Police
Delhi Police: While giving evidence on August 18 before the Supreme Court, the Delhi Police informed the Court that the Parliament march on July 20 was illegal since the protestors had not obtained permission for the same.Police further claimed that some criminals were also present at the Jantar Mantar demonstration. Police alleged that the situation worsened when the protestors reportedly broke the barricades and got into a physical fight with the police officers.Force had to be used as the situation was no longer peaceful.
Police Disclaim Use of Excessive Force
Police Action: Delhi Police told the Supreme Court that use of force in this case was inevitable in order to control the situation. Police denied the claims of excessive use of force and argued that the protestors did not abide by the terms for the protest.Affidavit from Deputy Commissioner of Police, Sachin Sharma, was submitted in Supreme Court on behalf of police. Affidavit was submitted in reaction to petitions requesting judicial probe into allegations of police excesses in the Parliament march case.
Committee of High Caliber Will Investigate the Accusations
Committee of High Caliber: The appointment by the Supreme Court of a five-member committee to look into the matter is important due to the nature of the accusations which include the behavior of protesters as well as police actions.This committee will act as an independent body that would look into the conflicting claims made. While protesters have accused the Delhi Police of overreacting, the police claim that the march held in Parliament was an unauthorized one and use of force had been made since they found the situation uncontrollable.
