Petition seeks SIT probe into alleged SIR voter deletions and challenges decisions linked to electoral-roll revisions
New Delhi: Petitioners have approached the Supreme Court for criminal proceedings against Chief Election Commissioner Gyanesh Kumar on the grounds of non-performance of his statutory duty with regard to the Special Intensive Revision (SIR) of electoral rolls. The petition, which is being filed under Article 32 of the Constitution, seeks a declaration that certain decisions, guidelines, and modifications of software that were made without concurrence of the other two Election Commissioners are unconstitutional and void. The petition has been filed just days after a news report in The Indian Express revealed that the two Election Commissioners, Sukhbir Singh Sandhu and Vivek Joshi, had raised objections several times against some of the decisions/orders in connection with the process of SIR, including the modification of Form 6 and handling of electoral roll data.
Petition for initiating prosecution under Representation of the People Act
The petitioner has sought direction to the concerned authority to file cases of complaint and start prosecution against Gyanesh Kumar, Senior Deputy Election Commissioner Maneesh Garg, Director General (IT) Seema Khanna and others who were responsible for the same under Section 32 of the Representation of the People Act, 1950. As per the petition, the following irregularities have been committed in the electoral process which includes change of form 6, concentration of electoral rolls data in the central server, restoration of voters through ECINet and filing of 16.10 lakh appeals in West Bengal regarding inclusion of voters
Petition challenging the decision taken without concurrence
The petition has sought quashing of certain decisions, guidelines, directives, and software changes allegedly undertaken without the complete concurrence of the Election Commission. The basis of the plea has been laid under Section 18 of the Chief Election Commissioner and Other Election Commissioners Act, 2023, which makes provision for decision based on the majority view when any difference is faced between the Commissioners. According to the plea, Joshi and Sandhu had raised objections regarding any modification of Form 6 in May 2026. The plea states that Joshi had made a recording that the statutory form could not be changed unless there was a corresponding change in the Registration of Electors Rules, 1960. The petitioner further states that after this there was a modification of Form 6 on the ECINet website that was seeking information regarding the presence of the applicants and/or their family members in the earlier SIR roll. The plea refers to a recording of Sandhu stating that this was "unauthorised and illegal".
SIT to be constituted for deleting voter’s name
The other prayer in the petition is for the constitution of an Independent Judicial Inquiry Commission/Special Investigation Team, chaired by a retired Judge of Supreme Court, with experts in Cyber Security & IT. This forensic audit of ECINet and ERONet will probe the circumstances of the deleting of 13 crore names from 30 states and UTs through the process of SIR. Also, an investigation has been sought on the filing of 16.10 lakh appeals against the Election Commission of India in the state of West Bengal.
Petition for restoration of original Form 6
In the present petition, the prayer is for quashing of the modifications alleged to have been made in Form 6 in the portals ECINet and ERONet, and the restoration of the original Form 6, which is prescribed in the Registration of Electors Rules, 1960. Also, the preservation of the server logs, database, communication and metadata of ECINet and ERONet starting from 1 October 2025 has been prayed for till further. The respondents in the petition are the Union of India, Election Commission of India, CEC Gyanesh Kumar, Cabinet Secretary, Maneesh Garg, and Seema Khanna. The petition has been filed through Advocate-on-Record Chand Qureshi.
