Supreme Court Directs Authorities to Ensure Safe Footpaths

Apex court stresses that pedestrian rights must take priority, directing authorities to ensure safe and accessible walking spaces across the country. 

Supreme Court: In a landmark observation aimed at improving pedestrian safety across India, the Supreme Court said that the Centre has to make sure that every road has enough and encroachment free space, for people to walk. The court also underlined the idea that the right to walk, safely on a clearly demarcated footpath, is a basic right under the Constitution, and it can’t be pushed aside just because motorized vehicles are getting more dominant.

The apex court observed that walking is the most basic way of moving around and it somehow becomes a key part of the freedoms under Articles 19 and 21 of the Constitution. In other words , the court felt that citizens should not be compelled to walk on busy roads just because footpaths arent there , or because the areas for pedestrians have been taken over by illegal encroachments. The judges also made it clear that safe walkways and related infrastructure are necessary, not only for safeguarding lives but for ensuring that access is real for everyone , including children, senior citizens, and persons with disabilities.

The Supreme Court further held that whenever a road exists, the concerned authorities also have an associated duty to ensure ,provide and keep up well demarcated footpaths. In other words the obligation is not optional. Urban Development Authorities, Municipal Corporations, Municipalities, and Panchayats have been mentioned as the main agencies, for building, maintaining and safeguarding pedestrian infrastructure, so the public can use it without trouble.

Expressing concern over the increasing disappearance of footpaths in cities and towns, the court described the issue as a larger urban governance challenge. It stressed that pedestrian rights must receive priority over motorized traffic and called for a dedicated legal framework to protect the right to walk. The court also noted that citizens should have access to legal remedies if authorities fail to provide safe walking spaces.

The ruling is expected to influence future urban planning, road development projects, and civic policies across the country. Experts believe it could lead to stricter action against encroachments and greater emphasis on pedestrian-friendly infrastructure, making Indian roads safer and more accessible for everyone.
