United Spirits says the prohibition order on McDowell’s No. 1 Celebration Matured XXX Rum was issued without following the legal process prescribed under the Food Safety and Standards Act.
Alcoholic beverage giant Diageo has filed a challenge before the Bombay High Court, contesting a prohibition order that was issued by the Food Safety and Standards Authority of India (FSSAI) against one of its well known rum lines. In the middle of all this is McDowell’s No. 1 Celebration Matured XXX Rum, made by Diageo’s India unit, United Spirits Ltd. at its Baramati plant in Maharashtra. In its submissions, United Spirits says that the food safety officer who put the ban in place, did not have the statutory power to pass such an order. They further argue that the regulator basically moved , without working through the due process set out in the Food Safety and Standards Act, 2006, and that it leaned mainly on a food analyst’s report to stop the product from being sold. This legal fight is also unfolding while FSSAI is looking at industry input regarding how flavouring agents are declared and regulated in alcoholic beverages. United Spirits has claimed that a ban at this stage , while the regulator is still weighing the bigger policy question is “premature, disproportionate and commercially prejudicial”. The Bombay High Court heard the case briefly on Monday, but no immediate relief was granted to the company. The court has asked the Union government to file its response by August 19.What Led to the Ban?
FSSAI has recently stepped up its attention on Indian-made foreign liquor (IMFL), more specifically on those products where makers are suspected of putting in added flavours to mimic the taste and aroma you normally get from standardised alcoholic beverages. So the regulator’s been looking at whether these ingredients are honestly properly declared, and also if they’re following the food safety rules that are already in place. In other words, they are checking both the disclosure side, and the compliance part .
Diageo’s Due Process Argument
United Spirits’ case is centered on procedural legality, not really on the product’s makeup itself, at least that’s how the company frames it. They say that under Section 38 of the Food Safety and Standards Act, food safety officers are empowered to collect samples and seize items for inquiry, but they do not have the authority to straightway pass a ban order. The firm also leans on Section 32 of the Act, which sets out the procedure for issuing improvement notices and then moving towards corrective action, before harsher steps like suspension or cancellation of licences can even come into play. As Diageo puts it, these procedural guardrails were not taken up in the present matter. So, the final result could end up having some notable effects on India’s alcoholic beverage industry and on the regulatory power that food safety authorities actually exercise.
